1. Introduction & Statutory Disclosures (ECT Act Sec 43)

These Terms and Conditions constitute a legally binding agreement between you (the "Guest") and Cool Cat Holiday Accommodation (Pty) Ltd (Registration Number: 2026/626178/07, CIPC Reg. 9463921745), operating the website https://cool-cat.co.za and providing premium holiday lodging and bed & breakfast hospitality in Strand, Western Cape, South Africa.

In compliance with Section 43 of the South African Electronic Communications and Transactions Act No. 25 of 2002 (ECT Act), our statutory business particulars are set out below:

2. Reservation, Rates & Payment Terms

All accommodation rates are quoted in South African Rand (ZAR - R) and include access to shared guest lounges, complimentary high-speed Wi-Fi, 24/7 continuous solar backup power, and secure gated parking.

• Standard Advance Bookings: For reservations made more than 7 days in advance where total value exceeds R1,000, a 50% deposit is required upfront to secure your dates. The remaining 50% balance is payable 3 days prior to arrival or upon check-in.
• Short Stays & Last-Minute Reservations: For bookings where the total cost is R1,000 or less, OR for reservations booked within 7 days of arrival, 100% full payment is required upfront.
• Payment Security (Paystack PCI-DSS): Online payments (Credit/Debit Card, Capitec Pay, SnapScan, and Instant EFT) are processed securely through Paystack in accordance with PCI-DSS Level 1 security standards. Cool Cat never collects or stores sensitive cardholder numbers.

3. Cancellation & Refund Policy (Consumer Protection Act Sec 17)

Under Section 17 of the South African Consumer Protection Act No. 68 of 2008 (CPA), consumers have the right to cancel an advance reservation, subject to a reasonable cancellation charge that takes into account the nature of the accommodation, length of advance notice, and potential loss of booking opportunity. Our fair cancellation schedule is structured as follows:

4. Check-In, Check-Out & Access Procedures

• Check-In Time: From 14:00 (14h00) on the scheduled day of arrival. Please notify hosts of your estimated arrival time via WhatsApp (063 712 4491).
• Check-Out Time: Strictly by 10:00 (10h00) on the morning of departure to facilitate thorough cleaning and sanitation for arriving guests.
• Late Check-Out: Late departures must be agreed in writing with management and may incur an additional hourly or day rate depending on incoming reservations.

5. House Rules & Guest Conduct

To ensure a tranquil, pristine, and safe environment for all guests, the following house rules are strictly enforced:

• Occupancy Limits: Only the specific number of guests registered and confirmed on the booking invoice may occupy the rooms overnight. Sub-letting or unregistered guests are strictly forbidden.
• 100% Strictly Non-Smoking Indoors: All suites, indoor lounges, bathrooms, and corridors are strictly non-smoking (including cigarettes, cigars, vapes, and e-cigarettes). A designated outdoor smoking area is provided. A R1,500 deep-cleaning and deodorizing fee will be charged if smoking occurs indoors.
• Quiet Hours & Noise: To respect all guests and neighboring residents, please keep noise low after 23:00. Official quiet hours are 00:00 to 06:00 (00h00 – 06h00). Loud parties, events, and bachelor/bachelorette gatherings are strictly prohibited.
• No Pets: For hygiene, allergy considerations, and property safety, pets are strictly not permitted on the premises.
• Visitors: Non-resident day visitors are permitted by prior host approval only and must vacate the property before 22:00.

6. Facilities, Wi-Fi & Solar Power

• 24/7 Solar & Inverter Power: The property is equipped with a solar and battery inverter system ensuring uninterrupted electricity, lighting, high-speed Wi-Fi, and refrigeration during municipal load-shedding or power interruptions.
• High-Speed Wi-Fi: Complimentary high-speed fiber Wi-Fi is provided (Network: Gouws | Password: 004eda35aef). Guests agree to use the network lawfully and refrain from downloading copyrighted materials or engaging in unlawful online activities.
• Secure Gated Parking: Off-street gated parking is available on-site for guest motor vehicles.

7. Property Damage, Breakages & Keys

Guests agree to take good care of the accommodation, furnishings, linens, and appliances during their stay.

• Any accidental damage, breakages, or staining must be reported to the host immediately.
• The lead guest will be held financially responsible for the direct repair or replacement cost of any property, structural, or electronic damage caused through negligence or willful misconduct.
• Lost property keys or gate remotes will incur a R350 replacement fee.

All personal information submitted during booking inquiries and transactions is processed in accordance with our Privacy Policy and the South African Protection of Personal Information Act No. 4 of 2013 (POPIA). Your information is securely maintained and never sold, leased, or disclosed to third parties.

10. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by, construed, and interpreted in accordance with the laws of the Republic of South Africa. Any legal proceedings arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the Western Cape Division of the High Court of South Africa or the Somerset West Magistrates Court.
